By the time eviction matters are sent to our office the landlord is no longer legally obligated to take the tenant's money. However, the landlord is still free to accept the late payment if the landlord chooses. There are many costs and fees associated with the late payment and the eviction. More than likely the landlord will expect to be reimbursed for these costs and fees as a condition of accepting the late payment.
If you are unable to work the matter out to the landlord's satisfaction, you will need to move out of the property and surrender possession of the property to the landlord. If the landlord accepts payment or if you move out before the court date (and the landlord is aware that you have moved out), the landlord may instruct us to dismiss the eviction action.
